The Breath Alcohol Program (BAP) certifies law enforcement agencies, officers and instrumentation to conduct alcohol testing on human breath for law enforcement purposes. The program operates under the authority of K.S.A. 65-1,107 and implementation of breath testing by K.A.R. 28-32-8 through 28-32-14.

The Kansas BAP has certified approximately 240 agencies, 5,100 operators and, 270 Intoxilyzer 9000 evidential breath testing (EBAT) devices throughout the state. The BAP manages and conducts training for law enforcement officers to become proficient in EBAT device usage, inspects instrumentation and maintains the files for the program. The BAP supports other state, county and municipal agencies by generating court documents, providing necessary supplies and offering expert witness testimony.
