KDHE's Hazardous Waste Permits Program

The Hazardous Waste Permits Program is responsible for administering Resource Conservation and Recovery Act (RCRA) Subtitle C permits and other such enforceable documents in the state of Kansas. This includes working with Kansas industries that treat, store and dispose of hazardous waste, or did so in the past.

Hazardous Waste Permits Section
This program is administered by the Hazardous Waste Permits Section of the Bureau of Waste Management. The Section consists of three units: Operating Facilities, Post-Closure Facilities, and Corrective Action.

Operating Facilities Unit
The Operating Facilities Unit works with active Treatment, Storage, and Disposal Facilities (TSDs). These facilities include waste combustion facilities, various other treatment facilities, facilities which store hazardous waste in tanks and containers for greater than 90 days, and other miscellaneous facilities. The Unit issues and modifies permits; provides oversight for closures, comprehensive combustion performance tests for the Hazardous Waste Combustor MACT and other hazardous waste operations, and reviews facility compliance reports.

Post-Closure Facilities Unit
The Post-Closure Unit works with permitted and interim status facilities that provide post-closure care of RCRA regulated units and areas of concern. This Unit issues and administers permits and other enforceable documents regarding operation and maintenance of engineering controls and groundwater monitoring designed to eliminate or minimize the effects of contamination on human health and the environment.

Corrective Action Unit
The Corrective Action Unit addresses unknown or suspected environmental releases at hazardous waste management facilities. Contamination of the environment may occur when waste materials are improperly stored, treated, or disposed, resulting in the release of hazardous constitutents into the land, air, surface water, or groundwater. The focus of Corrective Action is upon "solid waste management units" or "SWMUs" which include any unit at a facility where solid and/or hazardous waste was or is now managed at facilities that are or have ever been subject to Hazardous Waste Permitting.

Financial Assurance for Hazardous Waste Facilities
Hazardous waste facilities are required to provide financial assurance for the purpose of having designated monies available for closure, cleanup, monitoring, post-closure care, and third party liability contingencies.
