Hazardous Waste Program
What is a hazardous waste? Under Subtitle C of the Resource Conservation and Recovery Act (RCRA), a waste may be considered hazardous if it exhibits the characteristics of toxicity, ignitability, corrosivity, or reactivity. In addition, EPA has established specific listed hazardous wastes based on their origin or other reasons for being a threat to human health or the environment.
Hazardous wastes are generated from many different chemical products and by many different types of businesses and activities. Large generators tend to be manufacturers of various products while small generators are most often in the service industries. Being a generator of hazardous waste does not necessitate applying for a permit, but it does trigger certain notification requirements.
A facility is required to apply for a permit when they store hazardous waste for an extended period of time, treat, or dispose of hazardous waste. Also, if the facility did so in the past, they may be subject to the same requirements.

Statutes and Regulations Under Which the Hazardous Waste Program Operates
The hazardous waste program operates under K.A.R. 28-31-1 through 28-31-16. These Kansas regulations incorporate federal regulations from Chapter 40 of the Code of Federal Regulations (40 CFR) by reference.
