KDHE Issues Order to Eliminate Pollution Against Safety-Kleen, Dodge City

The Kansas Department of Health and Environment (KDHE) has issued an administrative order requiring the Safety-Kleen Systems, Inc. facility at 600 East Trail in Dodge City to implement environmental and safety precautions at the facility. The order also requires Safety Kleen to pay a $21,000 civil penalty for failure to comply with environmental regulations and permit requirements.

KDHE has determined that Safety-Kleen has failed to construct, maintain and operate the facility in manner to minimize the possibility of fire or release of hazardous wastes. The company has 90 days from March 12 to submit plans for implementing new environmental and safety measures, and 180 days to complete the plan once it is approved by KDHE.

The order also requires Safety Kleen to certify that the company agrees to operate the facility according to the permit, and to routinely collect hazardous waste samples for analysis.

Safety Kleen has 15 days from service of the order to file a written request for appeal of the order with the Kansas Office of Administrative Hearings. If the company does not file a request during that time, the order will become final when the 15-day period expires.
