The Kansas Department of Health and Environment (KDHE) has issued an administrative order with a $20,000 civil penalty against Dennis and Tom Kindsvater, d.b.a. Andy’s Truck Wash, for violations of their water pollution control permit and Kansas environmental regulations.
The violations cited in the order include the failure to properly operate and maintain pollution controls and the improper disposal of animal wastes from the truck washing facility, located southeast of Dodge City in Ford County.
The order contains a schedule that requires the company to remove the excess animal wastes spread on the land application field adjacent to the Arkansas River, submit a report and plans specifying which waste lagoons will continue to be used, and to submit a revised manure waste management plan.
The company has until February 19 to pay the civil penalty and agree to comply with the required actions in the order, or to file a notice of appeal with the Kansas Office of Administrative Hearings.
