KDHE Issues $8,000 Penalty to Reno Construction Company

The Kansas Department of Health and Environment (KDHE) has issued an administrative penalty of $8,000 to Reno Construction Company, a division of APAC-Kansas, Inc., and ordered the company to remediate conditions threatening the environment and public health and safety at the landfill located in Overland Park.

The latest inspection conducted by KDHE in May 2006 showed the following:

  • The waste cover in one part of the landfill had eroded and waste was observed.
  • Unauthorized waste such as metal and plastic buckets and containers; manufacturing waste; toys; electronic items; bagged household trash; and paint and aerosol cans were present and improperly disposed of in the area.
  • A significant amount of litter was found on the property.
  • The company had not paid solid waste tonnage fees due to KDHE from May 2005-May 2006.

Reno Construction Company is ordered to pay the penalty within 30 days of the August 3, 2006 order and take the following actions:

  • Screen and properly report all incoming waste each day.
  • Cover all areas of the landfill and properly maintain the cover.
  • Pay past due tonnage fees to KDHE within 30 days of the order.

Reno Construction Company has the right to request a hearing with the Kansas Department of Administration within 15 days of the order.
