Public Hearings Planned for Proposed Regulations for Wastewater Lagoons
August 19 - 7 p.m. Memorial Hall Auditorium, 120 SW 10th Ave, Topeka

The Kansas Department of Health and Environment (KDHE) will conduct a public hearings this month for proposed regulations to address municipal, commercial, and industrial wastewater lagoons. These regulations will ensure groundwater protections and practices are put in place for municipal,commercial, and industrial waste treatment lagoons.

The regulations will include the following:

  • 10 foot separation distance from wastewater lagoon liner to groundwater
  • reduction of allowable seepage rates over sensitive groundwater areas
  • site specific liner requirements for Equus Beds and other sensitive groundwater areas
  • use of dual membrane liners systems for industrial wastewater
  • hydrogeologic work for municipal, commercial and industrial facilities
  • lagoon closure plans for all new wastewater lagoons serving municipal, industrial, and commercial facilities
  • post construction testing requirements for wastewater lagoons

Kansas regulations require groundwater protection for many practices, but research has shown the importance of site specific regulations, especially when dealing with sensitive groundwater areas where shallow groundwater and sandy soil increases the vulnerability to the groundwater resource.

During the past two years, KDHE staff met with many interested groups and individuals concerning these changes. The public may submit written comments on the proposed regulations to Donald Carlson, KDHE, Bureau of Water, 1000 SW Jackson, Suite 420, Topeka, KS 66612-1367. Written comments may be provided to KDHE prior to September 10, 2004.

The public hearings will allow for KDHE to gather additional information from the public. They will be held as follows:

Topeka - August 19, 7 p.m. Memorial Hall Auditorium, 120 SW 10th Ave,
Dodge City - August 25, 7 p.m. Community College Auditorium, 2501 N. 14th Ave.,
Wichita - August 26, 7 p.m. Sedgwick County Extension Education Ctr., 7001 W. 21st St. North
