Deffenbaugh Industries Fined for Violations at Johnson Co. Landfill

The Kansas Department of Health and Environment has issued an administrative order assessing a $5,800 civil penalty against Deffenbaugh Industries, Inc. for violating the Kansas Solid Waste Act.

During a September 6 inspection of the Johnson County Landfill, which is operated by Deffenbaugh, a KDHE representative noted several environmental violations, including: inappropriate waste in a construction and demolition (C&D) landfill, failure to maintain or repair the landfill cover, failure to process more than 30 tires in the tire monofill, and failure to document that landfill employees had been properly trained.

Some of the September violations were repetitive of violations cited during previous inspections carried out on March 27, 2001, August 17, 2000, and November 30, 1999. Additional violations cited during the previous inspections include failure to assure adequate cover material, failure to properly operate stormwater and leachate controls, and failure to properly document the locations of special wastes.

The department's order is subject to administrative appeal.
