Landfill Operator Enters Consent Agreement with KDHE

Randy Vilela, owner and operator of Vilela C&D Landfill at 700 E. Washington in Pittsburg, has entered into a consent agreement with the Kansas Department of Health and Environment. The purpose of the agreement is to assure proper operation of the C&D landfill, and to facilitate Vilela's application to the department for a permit to operate a new landfill.

Under terms of the agreement, the existing landfill will be required to restrict access to prevent illegal dumping; screen all incoming wastes; and place any non-approved incoming waste into containers at a staging area for transport to an appropriate alternate disposal facility. Other conditions referred to within the agreement will become special conditions of the existing permit. The same terms and conditions would apply to any new permit issued to Vilela, if such a permit is indeed issued.

The agreement does not constitute a guarantee that KDHE will approve Vilela's pending permit application. Also, if Vilela does not fulfill his obligations under the agreement, the department could assess civil fines or take other legal action.
