Derby Recycling Ordered to Eliminate Pollution, Pay Penalty

The Kansas Department of Health and Environment has issued an administrative order directing Derby Recycling, 1401 S. Buckner Blvd., Derby, to remove unauthorized wastes from the company's construction and demolition landfill by November 13 and to pay a $15,000 civil penalty for illegally disposing of the wastes at the landfill.

The landfill is permitted to receive only construction and demolition materials. The illegal disposal was initially identified during an April 4 inspection conducted by state environmental officials and three subsequent occasions. After each occurrence, the department notified Derby Recycling management that they were out of compliance with environmental regulations and advised them of the need to clean up the landfill.

Derby Recycling has 30 days from receipt of the KDHE order to pay the fine, and 15 days from receipt to appeal the order.
