Lemon Shake Up Fined
The Kansas Department of Health and Environment (KDHE) has issued an administrative order assessing a $1,000 fine against Lemon Shake Up, for operating a food service establishment without a license at the 1999 Kansas State Fair in Hutchinson.
The violation has been documented on inspections conducted by authorized agents of the Secretary of KDHE.
Any establishment offering a food service at an event such as the Kansas State Fair must have a license if they operate the establishment for more than seven days in a calendar year. Each year during the State Fair, which runs ten days, state and local food safety inspectors check the vendors to verify compliance with this state regulation. In the course of the inspection of Lemon Shake Up, it was revealed the establishment did not have a license.
State law allows the Director of the KDHE Division of Health to issue fines for violations of state regulations adopted pursuant to the Kansas Food Service and Lodging Act. The order is subject to appeal to the Secretary of Health and Environment.
