Exide Corporation Enters Consent Agreement with KDHE
The Exide Corporation located in Salina, Kan. has entered into a consent agreement with the Kansas Department of Health and Environment (KDHE) to resolve violations of state hazardous waste regulations documented during a June 19, 1998 inspection.
The company has agreed to complete a Supplemental Environmental Project (SEP) in lieu of paying an $11,100 administrative penalty. The project criteria, as established under the agreement with KDHE, calls for the installation of a wood grinding unit at their Salina facility within six months of the agreement's effective date of April 5. The unit would grind waste boards and wooden pallets into usable floor sweep material.
In addition, Exide has agreed to train employees to operate the machine, and submit records and reports to KDHE documenting the waste reduction before and after installation of the grinder; as well as a full project report upon completion.
In order to complete a SEP in lieu of payment of the penalty, Exide must spend three times the amount of the penalty that would otherwise apply. The estimated cost of this project exceeds $33,300. If the company fails to complete the project within six months, it could face additional fines and enforcement action by KDHE.
The violations noted during the inspection were: failure to submit notification of Hazardous Waste Activity Form; accumulating more than one container of the same hazardous waste in a satellite area; satellite container not at or near the point of generation; failure to provide description and outline of capabilities of emergency equipment; and illegal disposal of shop cloth rags and cotton gloves contaminated with lead.
The facility had returned to substantial compliance with state regulations at the time the agreement was signed.
