State Fines Collingwood Grain, Inc. For KAQA Violations
The Kansas Department of Health and Environment (KDHE) has issued an administrative order assessing a $2,000 civil penalty against Collingwood Grain, Inc., for violations of the Kansas Air Quality Act (KAQA).
KDHE staff determined that Collingwood violated approval conditions for constructing an "air emission source" as defined under the KAQA. Collingwood failed to conduct performance tests and to notify the department of installation startup dates as required by law.
Collingwood was issued an Air Emission Source Construction Approval on November 4, 1996 for installation of a conveyor leg, load-out spout, and drag conveyor for its grain elevator located at 17th and Halstead in Hutchinson. Conditions outlined in the approval clearly indicate the deadlines for the required tests and KDHE notification. Upon completion of a July 14 inspection of the elevator, KDHE staff determined the company had not met those deadlines.
State law authorizes KDHE to issue fines for violations. The order is subject to appeal to the Secretary of Health and Environment.
