The breath alcohol program is responsible for the certification of agencies, instruments, and officers who test drivers suspected of being under the influence of alcohol. The program is responsible for breath testing under the authority of K.S.A. 65-1,107 and implementation of breath testing by K.A.R. 28-32-8 through 28-32-14.

There are around 230 agencies and approximately 4200 certified operators using over 200 Intoxilyzer 8000 instruments for breath testing throughout the state. Each year, 500 to 600 newly certified operators are trained in the State of Kansas. The Breath Alcohol staff inspects and recertifies each instrument annually. The Breath Alcohol staff supports other functions of breath testing by generating affidavits mandated for each driver’s license hearing, testimony in DUI cases and at administrative proceedings and maintenance of documentation required for breath testing.
